A coalition letter to Senate Judiciary Committee Chairman Chuck Grassley and Ranking Member Dick Durbin urges Congress to reject the American Innovation and Choice Online Act (AICOA, S. 4746). It asks the committee to shelve the bill and look for other ways to promote competition.
The letter argues that the bill picks out a handful of large platforms based on revenue and user counts, not market power, and treats common practices such as self-preferencing and product integration as presumptively harmful, even though existing antitrust law already covers anticompetitive conduct. It points to Europe’s Digital Markets Act, which AICOA resembles, as evidence that such rules delay new products and raise costs for small developers, and warns that a U.S. version would weaken American efforts to resist foreign rules aimed at U.S. firms. SPPI joined the coalition, which was led by the Information Technology and Innovation Foundation and the Association for Competitive Technology.
