With the 11th Circuit Court of Appeals striking down the rule and the Federal Communications Commission postponing implementation, industry experts agree that this regulation—initially set to take effect on January 27, 2025—is effectively dead.

“This rule is gone, and it’s not coming back,” Brenner said. “While the one-to-one consent rule is dead, it’s important to note that the Telephone Consumer Protection Act (TCPA) remains in effect, which means everything legal before is still legal, and everything illegal before is still illegal.”

The ruling is a significant win for businesses reliant on lead generation, comparison shopping platforms, and digital intermediaries, ensuring continued access to seamless consumer communication.
