PHOENIX, AZ—The Southwest Public Policy Institute (SPPI) celebrates two critical victories against the Federal Communications Commission’s (FCC) one-to-one consent rule. The FCC announced a 12-month delay in the rule’s implementation, initially set for January 27, 2025, following a legal challenge by Responsible Enterprises Against Consumer Harassment (REACH). On the same day, the Eleventh Circuit Court of Appeals struck down key provisions of the rule in IMC v. FCC, ruling that the FCC exceeded its statutory authority under the Telephone Consumer Protection Act (TCPA).
“These developments are a win for businesses, consumers, and innovation,” said Patrick M. Brenner, President of SPPI. “The rule would have disrupted vital industries, reduced access to services, and driven up costs. This delay and the court’s ruling reflect the importance of reining in regulatory overreach.”
The one-to-one consent rule required explicit, individual consent for each entity contacting consumers. Critics, including SPPI, warned it would cripple industries like online lending, lead generation, and ride-sharing, while increasing spam from unregulated foreign actors.
Brenner continued, “This decision aligns with concerns raised across industries, including the Online Lenders Alliance (OLA), whose statement highlighted the rule’s potential to restrict access to credit and burden both consumers and businesses.”
SPPI’s recent op-ed, “A Boon for Foreign Call Centers, a Blow to US Jobs,” highlighted these risks, emphasizing the need for targeted enforcement rather than sweeping rules that harm legitimate businesses.
The Institute calls on the FCC and its new leadership under FCC Chairman Brendan Carr to prioritize effective consumer protections that support economic freedom and innovation.
